Terms of Use for Green City Service

1. Definitions

1.1. Service – A web service targeted at companies operating in Ülemiste City, where in the free version, companies have access to their office and campus consumption data (heating, electricity, water, waste, etc.). In the paid version Green City+, CO2 emissions are calculated based on the company’s consumption, enabling better comparison and analysis of data.
1.2. Client – A company operating in Ülemiste City that uses the service.
1.3. User – An authorized representative of the Client who uses the service.
1.4. Service Provider – AS Mainor.
1.5. Service Intermediary – Mainor Ülemiste AS

2. General Provisions

2.1. By using the Service, the Client and all associated Users agree to abide by all the terms of use of the Service.
2.2. Using the Service includes processing the Client’s company data through the Service (viewing data, downloading, etc.).
2.3. The Client’s company consumption data belongs to the Client. All other information made available to users through the Service (CO2 emissions calculated based on the Client’s consumption data, campus consumption data, etc.) and related rights (except for exceptions mentioned below) belong to the Service Provider.
2.4. Billing for the paid service package is done on a prepaid basis on a monthly basis. The paid service package automatically renews, and the Client must inform the service intermediary’s client manager of their desire to terminate the service at least 30 days in advance.

3. Rights and Obligations of the Client and Users

3.1. The Client has the right to share the company’s data obtained through the service with third parties. When presenting company data using the visual elements of the service’s website (graphs, etc.), proper reference to the service is mandatory.
3.2. The User agrees not to intentionally provide false information about themselves or the Client through the service.
3.3. The User agrees to keep confidential the identification credentials required to log in to the Service. The User must immediately notify the Service Provider if it becomes apparent that the user’s identification credentials have been compromised by third parties. The Client is responsible for any potential damage arising from the use of the Service through the compromised User identification credentials due to the User’s actions or inactions.
3.4. The User agrees to promptly inform the Service Provider if inaccuracies are discovered in the data presented through the Service.
3.5. The Client and Users agree not to share data obtained through the service and the visual elements of the Service’s website with the intention of harming the service, the service provider, service intermediaries, or the image of Ülemiste City.
3.6. The Client agrees to compensate the service provider for damages (including indirect damages) arising from non-compliance with points 3.1 – 3.5.
3.7. The Client agrees to pay for all paid parts of the Service according to the Service’s price list and the presented invoices.

4. Rights and Obligations of the Service Provider

4.1. The Service Provider has the right to limit Users’ access to the Service if the User or Client violates these terms of use.
4.2. The Service Provider has the right to temporarily suspend access to the Service if necessary for updates, maintenance, etc.
4.3. The Service Provider makes all reasonable efforts to ensure that the data presented through the Service is accurate and up-to-date.
4.4. The Service Provider is not liable for any damages, including lost profits, resulting from the use of the Service, the inability to use it, or data inaccuracies.
4.5. The Service Provider is not responsible for the suitability and quality of services offered by partner intermediaries.
4.6. The Service Provider is committed to processing user personal data in accordance with data protection laws and only to the extent necessary for the functioning of the Service.
4.7. The Service Provider commits not to disclose the Client’s personalized consumption data to third parties.
4.8. The Service Provider has the right to unilaterally change Service fees by notifying the Client 30 days in advance.
4.9. The Service Provider has the right to unilaterally change the Service’s terms of use. The updated terms of use will be published on the Service’s website and will become effective from the date of publication on the website.
